1. Definitions

Please note that in this document these word shall have the following meanings;

1.1 “Buyer” means the person who buys Goods from the Seller.

1.2 “Seller” means GB DIY Store of Unit 3 & 4, Fox Covert Way, Nottinghamshire, NG19 0FR.

1.3 “Goods” means the articles that the Buyer agrees to buy from the Seller.

1.4 “Website” means www.gbdiystore.com as operated by GB DIY Store Ltd.

1.5 “List Price” means the price of Goods maintained by the Seller as amended from time to time.

1.6 “Terms and Conditions” means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by the Seller.

 

2. General

2.1 By placing an order through this Website you are agreeing to purchase Goods from the Seller subject to these Terms and Conditions.

2.2 A contract is made between the Seller and the Buyer once payment has been made for the Goods and a confirmation email of the order has been sent.

2.3 Any term sought to be imposed by the Buyer on the order will not form part of the contract.

2.4 The Seller is entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding Goods appearing on the Website.

2.5 If the Seller fails to enforce one or more of these Terms and Conditions, the Seller does not lose the right to enforce any remaining Terms and Conditions.

2.6 These Terms and Conditions shall be governed by the laws of England and any disputes will be resolved exclusively within English courts.

 

3. Price and Payment

3.1 The price you pay for the Goods will be the List Price displayed on the Website or as contained in a quotation, confirmed in writing by the Seller.

3.2 The Seller reserves the right to change prices without prior notice to reflect alterations by our suppliers, changes in taxation or the addition of duties.

3.3 If the List Price displayed have been misrepresented or are incorrect in any way the Seller will inform the Buyer of the correct price and will be given the right to amend or cancel the order.

3.4 The List Prices displayed will be inclusive of VAT.

3.5 Immediate payment is required for the Goods at the time of ordering in UK pound sterling.

3.6 Special offer discounts are applied to List Price before P&P.

3.7 Payment of the Goods including the VAT and any additional delivery charges must be made in full before the Goods will be dispatched.

 

4. Delivery

4.1 Subject to stock, the Seller will dispatch all orders the same working day when the order is received before 3pm.

4.2 Delivery of the Goods will be made by the Seller by notifying the Buyer that the Goods are available for collection at the Sellers premises or for delivery to the shipping address confirmed in the order by the Buyer and subject to the Terms and Conditions agreed at the time of order.

4.3 The Seller will, wherever possible, deliver all Goods within 10 working days of the order being placed and the Buyer should make any necessary arrangements to take delivery of the Goods.

4.4 The Seller only offers delivery inside the UK. Any special deliveries made outside of the UK are subject to terms in addition to those outlined in these Terms and Conditions.

4.5 The Seller will not be held responsible for failure to deliver the Goods by the estimated delivery date given at the time of order. As such, the Seller will not be liable for any losses, costs, damages or expenses incurred by the Buyer or any third party arising directly or indirectly from the failure to meet these estimated delivery dates.

4.6 The Buyer shall take full responsibility for any loss or damage to the Goods where the Buyer stipulates special delivery instructions and these instructions agreed to by the Seller.

4.7 The Buyer must check the condition of the parcel at the time of delivery. If the parcel is damaged then this should be expressly noted with the courier before signing for it. If the Buyer signs for the parcel without noting any damage, then the Buyer assumes responsibility of this damage or any damage caused to the Goods.

4.8 Ownership and risk of the Goods will pass to the Buyer upon the first attempted delivery of the Goods.

 

5. Cancellation and Returns

5.1 The Buyer must inspect the Goods immediately upon receipt and shall inform the Seller within 7 days of delivery if the Goods are damaged or do not comply with any of the contract.

5.2 Where the Buyer claims the Goods received are defective, faulty, damaged or not as described the Buyer must return or if otherwise requested by the Seller, provide evidence of the aforementioned defect, fault or damage. The Seller will provide the Buyer with either a prepaid returns label or arrange a collection of the Goods. The Buyer will not be refunded for any postage costs incurred for returning the Goods outside of the aforementioned prepaid services offered by the Seller. 

5.3 When the Seller receives the returned Goods, if any damaged is deemed to be the fault of the Buyers then the Buyer will be liable for the cost of resolving such damage.

5.4 Where Goods are ordered through our Website or by phone the Buyer has the right, in addition to any other rights, to cancel and return the Goods within 30 days, starting from the day the Buyer receives the Goods. The Buyer must notify the Seller in writing that they wish to exercise their right to cancel and return the Goods inside of this 30 day period. 

5.5 Goods must be returned at the Buyers cost and should be adequately insured. The Goods must be returned in a brand new and resalable condition including all original packaging, (which may be opened), any additional fixings, screws or accessories included with the Goods.

5.6 When the Buyer is exercising their right to cancel, the Buyer is fully responsible for the safe and undamaged return of the Goods. If the Seller receives the Goods back in an unsaleable condition or with missing parts and/or packaging (stated in section 5.5) the Seller reserves the right to deduct up to 50% of the Goods’ invoiced price from the final refund.

5.7 When the Buyer is exercising their right to cancel, a full refund will be issued against the Goods the Buyer returns excluding any additional postage and packaging charges for an improved, faster or expedited delivery. Only the basic postage charge will be refunded.

5.8 Please allow up to 7 working days from the Seller receiving the returned Goods for your refund to be processed.

 

6. Warranty

6.1 The Seller warrants that the Goods received by the Buyer will be accurate and correspond to the description given by the Seller.

 

7. Guarantees

7.1 In addition to the Buyers statutory rights, the Seller guarantees all Goods against faulty workmanship and materials for 180 days starting from the date of delivery. The Buyer accepts that the parts are maintained, well lubricated where needed, free from corrosion and installed correctly to windows or doors that are also plumb square and are otherwise in good working condition. 

7.2 The Seller will not be able to guarantee any parts which do not meet the terms in section 7.1 or parts which have been subjected to operating forces, are installed in high climatic conditions such as coastal or high polluted areas, have been taken apart or dismantled in any way or have had repairs done to them by any companies or persons other than the Seller.

7.3 The Seller will not be able to guarantee the finish of any items which have been cleaned with chemical or abrasive cleaning products or are installed in high climatic conditions outlined in section 7.2.

7.4 The Buyer has the right to request a repair or replacement for the Goods within this 180 day period subject to section 5 and 7 of the Terms and Conditions.

7.5 Some Goods listed for sale on this Website may come with an additional manufacturer guarantee, this guarantee is separate to the guarantee offered by the Seller in these Terms and Conditions. The details of an additional manufacturer guarantee will be displayed on the product page in the description. The Buyer is responsible for contacting the manufacturer when making a claim against the manufacturer guarantee.

 

8. Limitation of Liability

8.1 The Seller shall not be liable, in contract or otherwise, for any representations, advice or assistance given by or on behalf of the Seller in connection with the Goods or contract.

8.2 The Seller shall not be liable for any direct loss or damage suffered by the Buyer howsoever caused, as a result of any negligence, breach of contract or otherwise in excess of the price of the Goods.

8.3 The Seller shall not be liable under any circumstances to the Buyer or any third party for any indirect or consequential loss of profit, consequential or other economic loss suffered by the Buyer howsoever caused, as a result of any negligence, breach of contract, misrepresentation or otherwise.

8.4 The Buyer agrees that any liability on the part of the Seller for losses the Buyer suffers as a result of us breaking this agreement is strictly limited to the purchase price of the Goods you purchase.

8.5 The Seller shall not be liable for any losses suffered directly or indirectly due to defective, faulty or damaged Goods received by the Buyer in excess of the price of the Goods.

 

9. Severance

9.1 If any term of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction, such term will be severed and the remainder of the terms shall be in effect as if these Terms and Conditions had been agreed with the invalid, illegal or unenforceable term eliminated.
